2. Product Condition and Descriptions

RomTex sells industrial components in various conditions, including:

• New Old Stock (NOS)

• New surplus inventory

• Unused industrial components

• Products in original or replacement packaging

• Products specifically identified as "As-Is"

New Old Stock (NOS) refers to products that are unused but may have been manufactured or stored for an extended period.

NOS products may exhibit shelf wear, aged packaging, discoloration, or other cosmetic characteristics associated with long-term storage.

We make reasonable efforts to accurately describe product condition, manufacturer, part number, quantity, and country of manufacture when known.

Product photographs may depict the actual item offered for sale. Customers should carefully review all photographs and descriptions before purchasing.

Unless expressly stated, RomTex does not represent NOS or surplus products as newly manufactured or covered by an original manufacturer's warranty.

3. Pricing and Availability

All prices are displayed in U.S. dollars unless otherwise specified.

Prices and availability are subject to change without notice.

Products are offered subject to available inventory. RomTex reserves the right to correct pricing errors, product descriptions, or inventory discrepancies.

If an order cannot be fulfilled, the customer will be notified and any payment collected for the unavailable item will be refunded.

4. Orders and Payment

Orders are subject to acceptance and payment verification.

We may accept payment through the methods displayed at checkout.

RomTex reserves the right to cancel transactions involving suspected fraud, unauthorized payment activity, or violations of applicable laws.

Orders are not considered accepted until confirmed for fulfillment.

5. Shipping and Delivery

Shipping charges and available delivery methods are displayed during checkout or provided through an individual quotation.

Delivery estimates are not guarantees.

RomTex is not responsible for delays caused by carriers, customs authorities, natural disasters, or other circumstances beyond our reasonable control.

Responsibility for loss or damage during shipment will be determined by applicable law and the agreed shipping terms.

6. International Sales and Export Compliance

RomTex may supply industrial components to international customers, including customers in Latin America, subject to applicable U.S. export laws and trade restrictions.

International orders may require customers to arrange transportation through an approved freight forwarder.

Unless otherwise agreed in writing, international shipments arranged by RomTex are offered under DAP (Delivered at Place), Incoterms® 2020, with the named destination identified in the applicable order confirmation.

Under DAP terms, customers are generally responsible for import clearance, applicable duties, import taxes, and destination-country customs requirements.

Customers arranging their own freight forwarder must comply with the separately agreed delivery terms.

All international transactions are subject to applicable U.S. export controls, sanctions, and restricted-party screening, including regulations administered by the U.S. Department of Commerce and the Office of Foreign Assets Control (OFAC).

RomTex reserves the right to reject, suspend, or cancel transactions that may violate applicable trade restrictions or legal requirements.

Customers must not divert products to prohibited destinations, restricted parties, or unauthorized end uses.

7. Returns and Refunds

Eligible products may be returned within 14 calendar days of confirmed delivery, subject to our Return & Refund Policy.

Returned products must be unused, uninstalled, and in substantially the same condition as received.

Items explicitly designated "As-Is" or "Final Sale" may not be eligible for discretionary returns, except as required by applicable law.

Customers must obtain return authorization before shipping merchandise back to RomTex.

8. Product Application and Customer Responsibility

Customers are responsible for verifying that purchased components are appropriate for their intended applications.

This includes confirming:

• Manufacturer part numbers and specifications

• Dimensions and tolerances

• Load and speed ratings

• Lubrication and operating requirements

• Equipment compatibility

• Installation and maintenance requirements

Unless expressly authorized in writing by RomTex, products sold through this website are not offered or intended for use in automobiles or motorcycles.

Industrial components should be inspected and installed by qualified personnel.

RomTex does not provide engineering certification or application-specific suitability guarantees unless expressly agreed in writing.

9. Warranties and Disclaimers

Unless an express written warranty is provided, products are sold without additional voluntary warranties from RomTex, to the fullest extent permitted by applicable law.

NOS and surplus products may not carry an original manufacturer's warranty.

RomTex does not guarantee suitability for a particular industrial application or uninterrupted performance.

Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of Liability

To the fullest extent permitted by applicable law, RomTex Bearing & Supply LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from product use, equipment downtime, lost profits, or business interruption.

To the fullest extent permitted by applicable law, RomTex's aggregate liability arising from a product purchase shall not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply where prohibited by law or to liabilities that cannot legally be limited.

11. Intellectual Property

All original website content, branding, logos, product descriptions, graphics, and other materials owned by RomTex Bearing & Supply LLC are protected by applicable intellectual property laws.

Unauthorized reproduction or commercial use of RomTex-owned content is prohibited without written permission.

Manufacturer names, trademarks, and logos remain the property of their respective owners.
